Terms of Service

Effective date: 1 May 2025

These Terms of Service ("Terms") govern your use of the HomeValue NZ property estimate service ("Service") operated by @realty Ltd trading as HomeValue NZ ("we", "us"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. The Service

HomeValue NZ provides an online tool that generates an indicative, computer-based estimate of a property's market value using publicly available data. The Service is designed to help property owners have an initial, informed conversation with a licensed real estate professional.

The Service is free to use for property owners. We may charge real estate agencies a subscription fee to operate branded landing pages and access the lead dashboard.

2. Not a registered valuation

The property estimate provided is NOT a registered valuation under the Valuers Act 1948, and it is NOT a written appraisal under the Real Estate Agents Act 2008 Code of Conduct.

The estimate is generated by an algorithm using publicly available data including LINZ records, REINZ sales statistics, and council valuations. This data may be incomplete, outdated, or inaccurate for your specific property.

You must not rely on this estimate for any financial, legal, or investment decision. For an accurate assessment, obtain a registered valuation from a licensed valuer (Valuers Act 1948) or a written appraisal from a licensed real estate agent.

3. Your consent to be contacted

By submitting your details through the Service, you expressly consent to:

  • Being contacted by a licensed real estate salesperson in relation to the property you enquired about
  • Receiving your property report and related information by email
  • Follow-up communications regarding the sale or appraisal of your property

You may opt out of communications at any time by contacting the agent directly or emailing legal@rrea.co.nz.

4. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any New Zealand law
  • Submit false or misleading information, including addresses you do not own or have authority to enquire about
  • Attempt to access, scrape, or reverse-engineer the Service or its underlying data
  • Use the Service in a way that could damage, overload, or impair our systems
  • Resell, license, or commercially exploit the property estimates provided

5. Intellectual property

The Service, including its software, design, branding, and content, is owned by @realty Ltd and is protected by New Zealand and international intellectual property laws. You may not copy, reproduce, or distribute any part of the Service without our written permission.

Property data used in estimates is sourced from publicly available records (LINZ, REINZ, local councils). We do not claim ownership of this data.

6. Limitation of liability

To the maximum extent permitted by the Consumer Guarantees Act 1993 and Fair Trading Act 1986:

  • We are not liable for any loss or damage arising from your reliance on a property estimate
  • We are not liable for indirect, consequential, or incidental losses including lost profits or data loss
  • Our total liability for any claim arising from use of the Service is limited to the amount you paid us in the 3 months preceding the claim (which for free users is $0)

Nothing in these Terms limits liability for fraud, gross negligence, or rights that cannot be excluded under New Zealand consumer protection law.

7. Privacy

Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms. By using the Service you agree to the Privacy Policy.

8. Third-party services

The Service may use third-party services including address lookup, hosting, and email delivery. These services have their own terms and privacy policies. We are not responsible for the practices of third-party services.

9. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice. We may update these Terms at any time. Changes take effect when posted. Your continued use of the Service after changes are posted constitutes acceptance.

10. Governing law

These Terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the New Zealand courts. If you have a complaint about the Service that cannot be resolved directly, you may contact the Disputes Tribunal or your relevant consumer protection authority.
